Rules for Fair Use of Stories in the Phoenix Nest
Phoenix O'Nest
I hope that you enjoy your visit to the Phoenix Nest, and that you will share it with others. However:
Unless explicitly attributed to another source, everything on the Phoenix Nest web site (domain: https://fenixnest.net/), all pages and subdivisions therein, and all images and other supporting files on the site: html, css, javascript, jpg, png, and anything else), also known herein as the Nest, is the property and copyright of James A. Fulton, also known herein as Jim Fulton or Phoenix O'Nest or The Phoenix. All rights to those materials are reserved.
Without compromising those rights, just as I quote or use materials from other sites and resources, and in so doing strive scrupulously to adhere to the rules of fair use set by those sites, so I authorize fair use of stories, pages and exhibits on the Nest according to the following rules:
- I encourage you to share the Nest. The best way to do so is with links (i.e., URLs) to the stories you find interesting. You may use those URLs without restriction in your mail and other writings (whether printed or online), as well as in your social media.
- Commercial use of materials on the Nest is restricted by the Copyright Act of 1976, 17 U.S.C. § 107. Those rules prohibit, among other things, the copying or quoting of significant portions of materials from the Phoenix Nest, in any form for commercial gain, without prior written permission from the Phoenix.
- Quotations of short passages may made within the bounds of fair use, both in online and printed form, but no materials may be used out of context. All use of materials from the Nest must preserve the context of surrounding text and the links provided in the Nest:
- The materials must be quoted as written, without elisions that may affect the meaning of the passage.
- The complete URL (web address) must be provided for each section quoted.
- Links and citations inside quoted materials must be preserved in a usable form:
- If the materials are quoted on a web page, either
- the links in the quotation must work as they do in the Nest, or
- clicking the URL of the quoted passage must take the user directly to the quoted section of the Nest so that users can follow the links from there.
- If the materials are quoted in print, the complete citation for each link within the quotation, including the URL, as provided in the Nest, must be included with the quotation.
- If the materials are quoted on a web page, either
- Copying of whole or large portions of pages from the Nest to other web sites or documents requires prior written permission from the Phoenix.
- The Phoenix Nest is intended for online use, that is, in an internet browser that allows readers to traverse the many links that interconnect its parts into a whole and that connect it to the world wide web. Its online publication also provides immediate access to corrections and improvements. It is this that makes the stories in the Nest living documents. Printing destroys these capabilites, thereby replacing a living document with a corpse. Thus I discourage printing the stories you find here, and I will not normally grant permission to distribute entire pages, or even large parts of pages in printed form.
- Teachers in educational or religious institutions may read materials from the Nest, provided:
- They quote materials as written, without elisions that may affect the meaning of the passage.
- They do not distribute printed copies of significant portions of the materials.
- They provide each attendee in writing the complete URL (web address) for each section quoted.
- All other use of materials on the Nest requires prior written permission from the Phoenix.
I would appreciate an email notifying me when you make significant use of materials from The Phoenix Nest in a public or educational setting.
